Coljuegos

Coljuegos is the Bogotá-based state industrial and commercial company, created in 2011, that administers Colombia's revenue monopoly on games of chance, covering both venue-based and internet games. Online concession requirements and guarantees were set in 2016, and the concession is non-exclusive: any company meeting Coljuegos' requirements may obtain one.

Online operators work under a concession contract for internet games in the novedosos category. The contracts list slots, blackjack, roulette, baccarat, poker, live casino, virtual games and betting on sports and non-sports events; instant-prize games are limited to Aviator, Lucky Super 6, Cops and Robbers and those the board approves, while pool betting on sports and horse racing bets fall outside the contract. Each game type is certified by a laboratory accredited by Coljuegos. Bets are house-banked (contrapartida), pool (paramutual) or exchange (cruzada), the last with the operator's commission capped at 17% of gross revenue; players get at least 83% per game type. Sports and virtual-game bets may also be taken on devices in commercial premises reported to Coljuegos. Players are adults domiciled in Colombia with one verified account, transacting only in Colombian pesos.

The contract runs for 3–5 years from the date Coljuegos approves the performance guarantee; the application is free and decided within 2 months. Within the first 10 business days of the following month the operator transfers 15% of gross revenue minus prizes paid for each game type, with bonuses and jackpots counted as prizes once credited to the gaming account; a game type below the required return is settled at 17% of gross revenue, and a negative result counts as zero. Fixed rights are 811 monthly minimum wages (SMMLV) for each year of operation, paid in the first 20 business days of the year, and 1% administration costs apply to both parts. Guarantees are based on the contract value estimated in advance: performance at 15% for the concession and its settlement, wages and social benefits at 5% for the concession plus 3 years; they and a civil liability policy are due within 15 business days of signing. Prize payments and the return of player funds are covered by a fiduciary trust or a bank guarantee from an institution rated no lower than AAA, at the operator's cost.

The applicant is a company set up in Colombia or a Colombian branch of a foreign company, with activity code 9200 in the commercial register and a lifespan at least two years longer than the contract; an operator may have only one contract in execution at a time. Financial thresholds: working capital from 1,450 SMMLV, debt up to 70% of assets, equity from 30% of fixed rights, interest cover from 1.1. Documents in Spanish, including a SIPLAFT anti-money-laundering manual, are filed through the Portal del Operador, and the site address ends in .co and is held by the company for the whole contract. Player funds sit with a financial institution in Colombia, with monthly proof that the balance covers player balances, and any movement over 5% of it needs at least two people.
